Court - Superior Court of New Jersey

The Surrogate Court operates with limited jurisdiction. If a dispute arises, the Surrogate cannot intervene; the parties involved must resolve their issues through the New Jersey Superior Court. Disputes are filed with the Surrogate's Office, as the Surrogate also serves as the Deputy Clerk of the Superior Court, Chancery Division, in the Probate Part, and the Chancery Division, Family Part for adoptions. Additionally, the Surrogate acts as the Judge of the Surrogate Court.

In New Jersey, some matters filed in the Superior Court are submitted by the Surrogate's Court, which is responsible for managing and maintaining these filings. These matters include contested estates, judgments involving doubt and difficulty, guardianship appointments for incapacitated adults, and adoption procedures.

Filing complaints in the New Jersey Superior Court

To initiate an action, you must file a verified complaint and an order to show cause in accordance with Rules 4:83 and 4:67 of the Rules Governing the Courts of the State of New Jersey.

The Monmouth County Surrogate's Court does not utilize the JEDS System.
