GUARDIANSHIP BACKGROUND SCREENING

Proposed guardians must file two additional forms to meet AOC (New Jersey Administrative Office of the Courts) screening requirements to be considered for appointment. When the court appoints a person as a guardian, background screening is required.

Individual circumstances pertaining to background screening will be taken into consideration in determining the appointment of a guardian. The court refrains from automatic disqualification of individuals based solely on information derived from the screening process. Instead, the court meticulously evaluates all pertinent information. This systematic approach is intended to facilitate the court in arriving at the most judicious decision for the individual in need of potential guardianship.

The judge cannot execute a judgment of incapacity until the background screenings are completed. If the screenings are not completed within 60 days of filing the complaint, the judge may disqualify the proposed guardian.

Criminal and Civil Judgment History
Must be filed out by each proposed guardian regardless of relationship to the alleged incapacitated person.
